AirLister Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of the AirLister mobile application and website operated by AirLister Pty Ltd (“AirLister”, “we”, “our”, “us”).

By using AirLister, you agree to these Terms.

If you do not agree, you must not use our services.

1. Eligibility

You must be at least 18 years old to use AirLister.

By using the platform, you confirm you have legal capacity to enter contracts and list property for sale.

2. Nature of Our Service

AirLister is a For Sale By Owner (FSBO) platform.

We provide:

• Property listing tools

• Marketing packages

• Listing syndication to property portals

• Buyer enquiry forwarding

• Seller support services

We are not a real estate agent and do not act as your representative in negotiations or sales.

3. Seller Responsibilities

Sellers agree that:

• All listing information is accurate

• They have legal authority to sell the property

• Property disclosures comply with state laws

• Images and content do not infringe copyright

• Pricing and marketing claims are truthful

AirLister is not responsible for incorrect listings.

4. Listing Distribution

By listing with AirLister, you agree that:

• Your property may be published on third-party portals (e.g. realestate.com.au, Domain)

• Listings may be publicly visible

• Enquiries may be forwarded to your contact details

We do not guarantee listing approval by third-party portals.

5. Buyer Enquiries & Messaging

AirLister enables buyers to contact sellers.

You agree that:

• Enquiries may be stored

• Communications must remain lawful and respectful

• Harassment, spam, or misuse is prohibited

We may suspend accounts for misuse.

6. Fees & Payments

Fees are payable for listing and marketing services.

By purchasing, you agree that:

• Prices are displayed in AUD

• Payments are processed securely via third parties (e.g. Stripe)

• Services commence once payment is completed

7. Refund Policy

Unless required by Australian Consumer Law:

• Listing fees are non-refundable once listings are published

• Marketing upgrades are non-refundable once delivered

• Refunds may be considered where services were not provided

8. No Sale Guarantee

AirLister provides advertising and listing services only.

We do not guarantee:

• Property sale

• Enquiry volume

• Time on market

• Sale price

9. Intellectual Property

All platform content including:

• Branding

• Logos

• Website design

• Software

Remains the property of AirLister.

Users may not copy, reproduce, or resell platform materials without permission.

10. User Conduct

You agree not to:

• Upload false listings

• Impersonate others

• Mislead buyers

• Upload unlawful content

• Attempt to hack or disrupt the platform

Accounts may be suspended for breaches.

11. Limitation of Liability

To the maximum extent permitted by law:

AirLister is not liable for:

• Loss of sale

• Financial loss

• Listing errors

• Portal outages

• Buyer or seller disputes

Our liability is limited to the amount paid for our services.

12. Third-Party Services

We integrate with third parties including:

• Property portals

• Payment providers

• Hosting platforms

We are not responsible for their service interruptions or policies.

13. Account Suspension or Termination

We may suspend or terminate accounts if:

• Terms are breached

• Fraud is suspected

• Listings are unlawful

• Abuse of messaging occurs

14. Privacy

Your use of AirLister is also governed by our Privacy Policy.

15. Changes to Services or Pricing

We may update:

• Pricing

• Features

• Listing packages

Changes will not affect already purchased listings.

16. Legal Compliance

Users must comply with all property laws, including disclosure obligations under relevant state legislation.

17. Governing Law

These Terms are governed by the laws of Queensland, Australia.
